Kapnotes Inc. (“Kapnotes,” “we,” “us,” or “our”) provides educational market commentary and related content. This Privacy Policy explains what personal information we collect from visitors and subscribers, how we use it, and the choices and rights available to you. By using the Site, you acknowledge and accept the practices described in this Policy.
Information you provide directly:
Name, email address, and other contact details you submit when subscribing, creating an account, or contacting us
Billing information if you purchase a paid subscription (payment card details are processed by our payment processor; we do not store full card numbers)
Communications you send us (emails, feedback, survey responses)
Information collected automatically:
Device and browser information (IP address, browser type, operating system, device identifiers)
Usage data (pages viewed, links clicked, time on page, referring URLs)
Cookies, pixels, and similar technologies (see Section 6)

Kapnotes does not sell, license, or otherwise disclose for consideration your personal information to third parties.
We may disclose personal information to:
Service providers (hosting, email delivery, analytics, payment processing) bound by contract to use the information only to provide services to us
Professional advisors (lawyers, accountants) as needed
Authorities or other parties when required by law, including to comply with subpoenas, court orders, or lawful requests, or to protect the rights, safety, or property of Kapnotes, our users, or others
A successor entity in connection with a merger, acquisition, financing, or sale of all or part of our business (personal information may be among the transferred assets)
We and our partners may use cookies, web beacons/pixels, and similar technologies to operate the Site, remember preferences, and measure audience. You can control cookies through your browser settings. Disabling cookies may affect Site functionality.
Google Analytics. We use Google Analytics 4, a web analytics service provided by Google LLC, to understand how visitors find and use the Site. Google Analytics uses cookies and collects information such as your IP address (which Google truncates/anonymizes), the pages you view, referring URLs, and general device and location data, and reports aggregate traffic and usage statistics to us; we do not use it to identify you personally. Google processes this data as described at policies.google.com/privacy. You can opt out of Google Analytics on all websites by installing Google’s opt-out browser add-on at tools.google.com/dlpage/gaoptout, or by blocking cookies in your browser as described above.
HeyCatch. We also use HeyCatch, a web analytics service provided by HeyCatch (heycatch.ai), to understand how visitors find and use the Site. HeyCatch collects information such as the pages you view, referring URLs, interaction events, and general device information, and reports usage statistics to us. If you are a member, this activity may be associated with your account (such as your member ID and email address) so we can understand how the service is used. HeyCatch processes this data on our behalf as described in its privacy policy at heycatch.ai/privacy. You can limit this collection by blocking cookies or scripts in your browser as described above.
Our marketing and newsletter emails identify Kapnotes as the sender, include our physical postal address, and contain a working unsubscribe link. You may opt out of marketing email at any time by clicking “unsubscribe” in any message or emailing support@kapnotes.com. We may still send transactional or account-related messages (e.g., billing notices) after you unsubscribe from marketing.
If you opt in to Kapnotes Alerts, we collect and store your mobile phone number and a record of your consent (including the date and time you checked the SMS consent box). We use this information solely to send you the text alerts you have requested — notifications of new stock entries and market commentary — and occasional account or service messages.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with, or sold to, any third party. The above excludes the service providers we use to transmit messages (such as our SMS delivery platform and mobile carriers), who process your number and message content solely to deliver the alerts you have requested, and disclosures required by law.
You may opt out of text messages at any time by replying STOP to any Kapnotes text or by changing your alert preferences on your Account page. We retain your consent record after opt-out as evidence of the consent that existed while messages were being sent.
We maintain a data security program with reasonable administrative, technical, and physical safeguards designed to protect the security, confidentiality, and integrity of private information, consistent with the New York SHIELD Act (N.Y. Gen. Bus. Law §§ 899-aa, 899-bb). No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Breach notification. If a breach of security affecting your private information occurs, we will notify you and applicable authorities as required by N.Y. Gen. Bus. Law § 899-aa and other applicable law.
We retain personal information for as long as needed for the purposes described in this Policy — including maintaining your subscription, complying with legal obligations, resolving disputes, and enforcing agreements — and then delete or de-identify it using secure disposal methods.
We may update this Policy from time to time. Material changes will be posted on this page with a new effective date, and — if the change expands how we sell or share previously collected personal information — we will provide prominent notice and, where required by law, obtain consent before applying the change retroactively.
